Category 1 and 2 dogs

The law of January 6, 1999 aiming to prevent accidents and aggressions with mastiffs imposes since 01/01/2010 to the owners of dogs categorized 1 and 2 a license of detention.

During the mandatory training provided to future owners of categorized dogs, Mr. Buoli, president of the Center Cynophile St Roch, explains: “Category 1 and 2 dogs are considered dangerous and classified according to their morphological characteristics. Owners have the obligation to declare their dog to the town hall of their place of residence.

Category 1 brings together attack dogs not registered in a recognized stud book. Their morphological particularities can be likened to Tosa, Mastiff or Boerbull, the American Staffordshire terrier also called Pit bull. They must be sterilized.

Category 2 is made up of defense or guard dogs made up of 3 breeds and one type, benefiting from an entry in a recognized genealogical book: American Staffordshire terrier (formerly Staffordshire terrier), Rottweiller, Tosa, Rottweiller type.

Category 2 dogs can travel on public transport, access public places on a leash with a muzzle. Those in category 1 can only access public roads with a muzzle and leash. They cannot be imported, whereas importation is done for category 2 dogs as well as parking in the common areas of apartment buildings kept on a leash with a muzzle.

Before acquiring a categorized 1 or 2 dog, a day of training is mandatory. The certificate of aptitude is required for the application for a detention permit. Other documents are necessary to compile the file: the behavioral evaluation carried out by a veterinarian is compulsory for any category dog aged 8 to 12 months, the dog’s papers and his up-to-date anti-rabies vaccine health record, a certificate of civil liability and the sterilization certificate for category 1 dogs only. After agreement, the permit is to be collected at the town hall.

Failure to comply with these obligations is punishable by fine or imprisonment. A categorized dog is not necessarily a dangerous dog. CRJ
